MOFCOM Announces Final Ruling on Anti-dumping Investigation Against Imported Broiler Originating in Brazil

On February 15, 2019, MOFCOM released Announcement No. 6 of 2019, announcing the final ruling on the anti-dumping investigation against the imported broiler originating in Brazil. MOFCOM ruled that dumping existed in the imported broiler originating in Brazil, the domestic industry has been substantively damaged, and there was a causal relationship between the dumping and the substantive damage. MOFCOM decided to impose anti-dumping duty on the above product by 17.8%-32.4% duty rates for five years from February 17, 2019. In addition, MOFCOM accepted the application for price commitments from some Brazilian export enterprises, and did not impose anti-dumping duties on related products not lower than the committed price.

Responding to the application of the domestic broiler industry, MOFCOM released an announcement on August 18, 2017, deciding to initiate the anti-dumping investigation against the imported broiler originating in Brazil. After that, China carried out the investigation strictly according to the relevant Chinese laws and regulations and the WTO rules. MOFCOM announced the positive preliminary ruling on June 8, 2018 based on preliminary investigation, and made the above final ruling after a series of further investigations.
